Terms of Use

1. Agreement to These Terms

These Terms of Use govern your use of the AIM Services App, its referral forms, and related services (together, the "Service"), operated by AIM Services LLC, an Arizona limited liability company ("AIM Services", "we", "us"). By creating an account, signing in, or submitting a referral, you agree to these Terms and acknowledge our Privacy Policy.

Members also agree to the partner agreement presented in the app, and partner businesses agree to the Business Partner Agreement. Those agreements govern commissions, fees, billing, and the other matters they cover. If they conflict with these Terms on those matters, the agreement controls.

2. Eligibility and Your Account

• You must be at least 18 years old and able to enter into a binding contract.
• The information you give us, including your name, email, and phone number, must be accurate and kept up to date.
• You are responsible for keeping your password secure and for all activity under your account.
• Tell us right away at office@referaim.com if you believe your account has been used without your permission.

3. How the Service Works

AIM Services connects members and insurance agents who refer customers with independent partner businesses that provide home and auto services. AIM Services does not perform those services. Each partner business is independent and solely responsible for its own work, pricing, licensing, insurance, warranties, and dealings with customers.

We do not guarantee that any referral will result in a job, or that any member will earn any particular amount.

4. Submitting Referrals

• Only submit a person who has asked for, or agreed to be contacted about, the service you are referring them for.
• You are responsible for having permission to share the contact details you submit, and for making sure they are accurate.
• Do not submit fake, duplicate, or misleading referrals, or refer yourself or your own household to earn a commission.
• We may decline, void, or correct the attribution of any referral that breaks these Terms or your agreement.

5. Commissions, Fees, and Payments

• Member commissions, including how they are earned and when they are paid, are governed by the partner agreement you accept in the app. Insurance agents do not earn commissions.
• Commission payouts are sent through Stripe. To be paid, you must complete Stripe's account setup, including any identity and tax information Stripe requires, and you agree to Stripe's Connected Account Agreement.
• You are responsible for any taxes on amounts you receive.
• Partner business fees are governed by the Business Partner Agreement and are charged to the payment method on file through Stripe.

6. Acceptable Use

You agree not to:

• Use the Service for anything unlawful, or to send spam or unwanted solicitations.
• Harass anyone, or impersonate another person or business.
• Access another person's account, or try to get around security or access controls.
• Interfere with, overload, scrape, copy, or reverse engineer the Service.

7. Closing Your Account

Members can delete their account at any time from Settings in the app. Partner businesses can close their account from Settings → Business Profile → Close Account. Closing an account ends access to the Service.

Obligations that arose before closing, such as fees already incurred or commissions already earned under the applicable agreement, survive closing. We keep certain records after closing, as described in our Privacy Policy.

We may suspend or close an account that breaks these Terms or the applicable agreement, or where required by law.

8. Our Content

The Service, including its software, design, and the AIM Services name and logos, belongs to AIM Services. We give you a limited, personal, revocable permission to use the Service for its intended purpose while your account is in good standing.

9. Third-Party Services and App Stores

The Service relies on third parties, including Stripe for payments and payouts. Their terms and privacy policies apply to your use of their services, and we are not responsible for them.

If you downloaded the app from the Apple App Store or Google Play, these Terms are between you and AIM Services only. Apple and Google are not parties to these Terms and are not responsible for the app or its content.

10. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Service will be uninterrupted or error-free.

11. Limitation of Liability

To the fullest extent permitted by law, AIM Services will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, arising from your use of the Service or from any partner business's services. Our total liability for any claim relating to the Service will not exceed the greater of $100 or the amount you paid to AIM Services in the 12 months before the claim arose.

12. Indemnity

You agree to defend and hold AIM Services harmless from claims arising out of the referrals you submit, the services you provide if you are a partner business, or your breach of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Maricopa County, Arizona, unless the applicable agreement provides otherwise.

14. Changes to These Terms

We may update these Terms from time to time. We will change the "Last updated" date above, and for material changes we will notify you in the app or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.
